Luxury tax history and how it applies to the Thunder

by Royce Young on August 22, 2012 at 1:42 pm 232 Comments

Ronald Martinez/NBAE/Getty Images

In Oklahoma City these days, the words “luxury tax” have become a brand name. It’s almost as Oklahoman as saying Boomer Sooner or Orange Power or doing something stupid. Here’s how far it’s gone: My mom breathlessly used “luxury tax” in sentence the other day, and used it properly.

It’s gone so far that I really don’t feel it necessary at all to explain what it is in this intro. Because you already know. And if you don’t, you also probably don’t know who James Harden is and you also are probably looking for this website, not here.

With the conversation about whether or not the Thunder can or will pay up to keep their core dominating our lives right now as we sit and wait, a little history might be relevant. As in, how much precedent is there for small market teams paying the NBA’s penalty for breaking over the salary cap?

You might be surprised — quite a bit.

Via Mark Deeks of Sham Sports who did serious work researching team payroll histories, since 2002 when the luxury tax system was implemented, seven teams have gone without ever paying it. One being, you guessed it, the Thunder/Sonics. (The other six: the Wizards, the Bobcats, the Bulls, the Warriors, the Clippers and the Hornets.)

The most any team has ever paid in a season might surprise you. It was the 2002-03 Trail Blazers who had a $51,971,000 tax bill. The highest amounts teams have paid over that time is the Knicks ($195,288,145 total), the Mavericks ($150,530,433), the Blazers ($89,052,474) and the Lakers ($84,417,253).

Of note: Portland is technically considered a small market being the 22nd largest TV market in the U.S. and the 22nd largest in the NBA. Oklahoma City is the 45th largest overall, and the 28th largest in the league. Memphis and New Orleans are the two cities behind OKC, with Memphis having paid the luxury tax in 2003 and 2006.

Other small markets (I’m determining small market on teams outside the top 15 in market size) that have paid the tax: Miami (four times, $22,667,988 total), Denver (three times, $21,157,439 total), Cleveland (three times, $43,126,121 total), Orlando (three times, $38,951,508 total), Sacramento (twice, $30,518,745 total), Portland (four times, $89,052,474 total), Indiana (three times, $8,809,087 total), Utah (twice, $8,103,619 total), Milwaukee (once, $4,734,000 total), San Antonio (five times, $12,597,554 total) and Memphis (twice, $11,297,452 total).

The teams that have paid it the most are the Mavs (every year, nine times), the Lakers (seven times), the Knicks (seven times), the Celtics (six times) and wait for it, the Spurs (five times).

Again, there’s a precedent for smaller market teams paying the bill. However, there’s a different catch this time around that makes things different for OKC: The tax is much more punitive than its ever been. Starting in 2013-14, instead of dollar-for-dollar like it was with all of these previous payments, it’s an escalating tax depending on what you’re over. For the Thunder if they sign Harden, it’ll likely be $1.50 for every dollar over the threshold or potentially $1.75 depending on how Harden’s deal was done.

It’s obvious though that the playing field has never been level in the NBA. Outside of the Bulls and Clippers, all the big markets have broken into the tax, with most of the smaller ones keeping the bill low or nonexistent. But teams in OKC’s position have almost always ponied up and paid it. It’s why Paul Allen broke the bank in 2003. He had a contending team and wanted to chase a title. Same goes for the Spurs, the Cavs with LeBron, the Pacers in 2006 and Sacramento in the first part of the decade with Chris Webber. I’m not sure there’s an example of a team being in a title contending position that didn’t in order to continue the run.

Will the Thunder fall in line with that? I think so. While the tax is harsh, you don’t abandon a title chase like that. At least other teams haven’t. Plus, it’s not like the Thunder are committing to paying the tax for the next 20 years. It could be for only a season, maybe two. With options with Kendrick Perkins and the amnesty clause or other moves, OKC could dive right back under the tax line if necessary. And then when Durant, Westbrook, Ibaka and Harden are up again in five years, you reassess and plan for the next course.

We still have to wait and see though. This may not be decided until next summer. Which would be awesome, because that means we can continue to talk about it nonstop for another year.

I like this list when thinking about what clubs can afford in relation to luxury tax (rather than pure market size comparisons):

http://www.forbes.com/nba-valuations/#p_1_s_a0_

It would seem the value of the clubs and its operating revenue would be more important.

If James Harden was a dick and not a beloved character with some unusual, slick facial hair wouldn't we be talking about how great of a trade asset he is?

He's young and talented, but unless you trade away Westbrook (not going to happen) then Harden isn't the best fit to our system. Thabo starts because he's a good defender and we have Westbrook and Durant to take care of offensive matters.

Yes, he leads the 2nd unit, but this year hopefully we'll have a healed Eric Maynor and PJ3. Shouldn't we consider trading Harden for BOTH tax AND sporting purposes?

My dream trade? Harden - DeMarcus Cousins, direct trade. Works in terms of money and while the Kings already have Evans as a SG, Harden would be their leader. Cousins will likely want out to fulfill his undoubted potential. We could get rid of Perkins and slot it Cousins. Cousins and Ibaka in the paint? WOW...Sorry Lakers, D-12 is not enough. We also manage to keep Thabo (with a better contract), Maynor and a good vet SG ala JR Smith

Option 2: Would love to have...Kevin Love but not sure how it works money-wise as Ibaka and Harden will command a lot of money and not sure our other tradeable assets are appealing to the Wolves.

What do you guys think?

OBoy
OBoy 5pts

@Sergio Santos Kevin Durant is a pretty good trade chip....Wait, Why are we making a trade?

Sergio Santos
Sergio Santos 5pts

@OBoymuzik  @Sergio Santos Why are we making a trade? Harden can command max money if he explores free agency, so he won't come cheap. We'll have to amnesty Perkins to keep us out of luxury tax threshold or at least close to it so that we don't pay a lot. If tax is a problem (which we think it is), we should either shop Harden for a cheap SG (ala JR Smith) or at least pay good money for someone who can make a difference (our weakness is on the inside). There  you go...

OBoy
OBoy 5pts

@Sergio Santos also if we're trading harden it needs to be for someone with 2-3 years left on a rookie contract or someone who won't command max, Cousins will get max or near max

OBoy
OBoy 5pts

@Sergio Santos your orignal post made it seem like trading harden would be a better option over keeping him..unless we have decided that we're not giving him max (which we haven't decided) we might as well let the year play out and decide if we think he's worth max in restricted free agency

but in your dream trade...where perkins go?

Sergio Santos
Sergio Santos 5pts

@Jokazc Perkins is amnestied....but hey, he'll have to be if we somehow manage to keep Harden. And if we do keep Harden, it'll be at the expense of Perkins and in the future Thabo, because he'll command 10M-12M easily...

shiki

@Sergio Santos Howard stays in a team which has 4 starters who are older than 30,they will be worse and worse.it makes Perk not important as these 2 seasons. We can find a cheap C to replace him.

Sergio Santos
Sergio Santos 5pts

My point is: We're gonna lose our C (not the best centre in the NBA, but useful in the paint) to keep Harden, a player that while talented is not the best fit taking into account our current roster. Why not shop him for a good C ?

Jokazc
Jokazc 5pts

@Stringer Bell  @Sergio Santos  @Jokazc yeah,thabo wont ask (or get from OKC) 10 mil...

And Harden and Ibaka's extension start from 2013-2014 season?!

only trade I want Presti to do is Cook(or lazar, because thabo and cook can play sf for 4-5 minutes :D),1 pick-fredette

@Jokazc soo funny. The problem is that KD doesn't lie about his height like most NBA players. KD IS 6'9", but so is Perk, and Griffin probably. KLove is really more like 6'8" I think.

 @El Prez

Not sure if I'd call these sleepers, but have you seen any of these?

- Young Adult (youth-lit writer--Charlize Theron--returns to her hometown to "save" her old boyfriend from the tedium of small-town family life)

- Cedar Rapids (sheltered middle-aged man--Ed Helms--goes off to a convention)

- Friends with Kids (just what it sounds like; an unflinching look at marriage and family)

- Carnage (Kate Winslet and Jodie Foster as parents; a civilized discussion over a schoolyard incident devolves and everyone is exposed . . . you would LOVE this one; it's brilliant)

- Take Shelter (premonitions of a real storm or the storms of mental illness taking over?  will keep you guessing beyond the end)

- Another Earth (heartbreaking look at "what if" when you've really messed up and can't make it right)

- The Future (very quirky; you'll love it or hate it . . . young couple coming of age)

- 50/50 (guy movie revolving around cancer; seriously funny)

- Catfish (sort of a documentary about the real life behind an internet persona)

- The Way (haven't seen it, but want to . . . Dad tries to understand his late son by walking a mission trail)

I know that's more than five, but maybe you'll find a few in there.  I'll look for your reviews by Sunday night!  :)

I would add a definite second to Young Adult, Another Earth and 50/50. I'll add A Separation to that list, too. I really liked Another Earth. Brit Marling, the woman behind it, is an actress/producer/writer to watch over the next few years, I think.

If I tell you why Catfish would depress you, it would ruin the movie.

Here's the trailer for YA: http://www.youtube.com/watch?v=Ar_-v7dEEoo

--but I gotta say it's better than it looks here.

I did read the Carlson article this morning . . . actually posted about it in the leftover thread from last night.  While I think her intentions might have been good, her whole argument for Harden staying in OKC was based on some fairly unflattering assumptions about both.  Completely agree with Royce's critique of the article . . .

El Prez

Why would Catfish further depress me? I like Charlize Theron--that movie where she played a murdering prostitute was tough to watch. I'll take your advice though...pass on Catfish, and go with Young Adult. Did you read the Jenni Carlson piece and not get depressed? i wasn't ready for her to return this quickly. It all seemed to start at that point...my neutrons going south.

TC--thanks for the excellent suggestions. I'll try and see three of those...Carnage with Kate Winslet and Jodie Foster, Catfish, and 50/50.
