Remember that super weird guy that sued KD over the “Durantula” nickname?
Essentially the story is this: Mark Durante, a guitarist for a bunch of bands you’ve never heard of (like The Revolting Cocks), sued Durant for the use of the nickname “Durantula,” claiming that was his nickname first.
Now, KD’s people are pushing back against the lawsuit. Via TMZ:
Kevin Durant is fighting back against a lawsuit claiming he stole the nickname “Durantula” from a 1980s musician … arguing that he didn’t give himself the moniker and doesn’t even use it to make money. As TMZ first reported, the Oklahoma City Thunder star was sued by guitarist Mark Durante, who claimed he had trademarked the name and used it as to sell merchandise long before KD came along.
But in his response — filed earlier this month in Illinois Federal Court — Durant claims the media and his fans have been calling him by the name his whole career. Durant says he has NEVER used the name to sell merchandise … so Durante’s lawsuit has no merit.
In addition, Durant claims Durante (who has played with the likes of Public Enemy, The Aliens and The Next Big Thing) that no one would ever confuse the two. KD wants the lawsuit tossed completely and wants Durante to cover his legal fees.
A judge has yet to rule.
I think this is one of the dumbest lawsuits. I'm sure there are other people who have had that nickname yet they don't care that people call KD that since he is the one who came up with it. He had no part of that so there is no way it is his fault.
Stupidest. Lawsuit. Ever.
Can the court rule that Durante should, instead, use the name "revolting cock" as a nickname?

I agree. Unfortunately I'd imagine Durante doesn't have the money for a cold beer let alone KD's fees or he never would have filed this joke suit in the first place.
